Terms & Conditions

Welcome to our terms and conditions of all our rentals.

This is important and affects your legal rights and obligations, so please read them and other terms referenced in this document carefully. Each guest must affirm via electronically or verbally agreement to these terms and conditions and becomes legal binding at the point the reservation is secured by payment. Booking through a 3rd party does not waive SkyRun’s rights under these terms and  conditions.

By submitting this reservation, you are agreeing to the following terms and conditions:

PAYMENT: Your payment of 1/2 of the grand total is paid at the time of booking. The remainder of the balance is paid 60 days prior to arrival. If you booked through Airbnb or another 3rd party site, they have collected your payments according to their payment terms & conditions.

TAXES & FEES: If taxes and fees are not included in quoted rates guests will be responsible for taxes and fees at the time of occupancy. For rentals of less than 182 days, a minimum of 12% to 13% Sales Tax will apply (7% State of Florida plus 6% Sarasota County Tourist Development Tax OR 5% Manatee County Tourist Development Tax). In addition, any local accommodations taxes and fees plus a reservation fee are added to all rentals. Tax rates are calculated according to state sales tax, state and local accommodations taxes and fees and local laws in force at the time of the Agreement. Guest is responsible for payment of all applicable taxes in effect at time of occupancy.

CANCELLATION POLICY: Cancellation by 180 (or more) days prior to arrival results in a 100% refund. Cancellation between 30 and 180 days prior to arrival results in a 50% refund. Cancellation within 30 days of arrival results in the forfeiture of your entire rent. In the case of a SkyRun Sarasota cancellation, through no fault of the guest, the guest may be entitled to a refund of lodging for the unused nights less certain booking costs. SkyRun Sarasota's liability shall not exceed the total amount paid for the unused nights in the event of cancellation.

LONG-TERM RESERVATIONS: Reservations of 30 nights or more are considered long-term and have different requirements. Long-term reservations are subject to their own cancellation policies, payment policies and terms. All monies paid for long-term reservations are non-refundable at the time the payment is collected. No refunds will be offered for cancellations. One third of the total booking cost will be taken at the time of booking. The remaining balance will be divided into equal monthly payments so that the reservation is paid in full 30 days prior to guest arrival. Long-term reservations of 182 days or longer are not subject to local sales and lodging taxes. SkyRun Sarasota reserves the right to cancel long-term reservations within 72 hours of booking.

CHECK-IN: Your property will be ready for check-in at or after 4pm Eastern. Early check-ins are not allowed unless prior arrangements have been confirmed and agreed to by SkyRun Sarasota in writing.

CHECK-OUT: All guests must be out of the property no later than 10am Eastern. Departure instructions must be followed to avoid additional charges, at the sole discretion of SkyRun Sarasota.

As reservations are carefully scheduled in advance, no refund will be given if a guest leaves prior to their reserved departure date, regardless of reason.

SPECIFIC PROPERTY BOOKED: You have booked a specific property. However, on extremely rare occasions, the specific property you booked may not be available due to circumstances beyond our control such as maintenance problems with the property booked, or a change of ownership or management of the property since you booked. In the event that the property you booked is not available, SkyRun Sarasota will attempt to place you into a similar or better property at the same price or offer you another property at a lower rate. If the replacement property offered is not acceptable to you for any reason, SkyRun Sarasota will cancel your reservation and refund your total amount paid. SkyRun Sarasota does not guarantee that a suitable property will be able to be found. If the property you have rented becomes un-occupiable before or during your stay (HVAC or refrigerator breaks for example), SkyRun Sarasota will also make our best effort to find you a similar or better place to move to and if unable to do so, refund the portion of your rent unused.

DAMAGE, TRASH, & CLEANING: Any damage, excessive cleaning and/or excessive trash left by Guest may result in incidental charges such as added housekeeping, at the sole discretion of SkyRun Sarasota.

SMOKING: Smoking is prohibited in the property at all times. Condo and other Home Owner Associations may restrict smoking on complex grounds, porches and other community areas. Removal of smoke detectors is illegal and will result in charges. Violators are subject to a $500 fine in addition to applicable cleaning charges at the sole discretion of SkyRun Sarasota.

HOUSEKEEPING: SkyRun Sarasota properties are SELF CATERING at no extra charge. That means that the property will be clean upon your arrival and will be cleaned after you leave. Housekeeping includes fresh linen and towels when you arrive. During your stay, YOU are responsible for any cleaning including taking out the trash and washing the linens that SkyRun Sarasota provides if you choose to wash them.

MAINTENANCE: Guest agrees to notify SkyRun Sarasota as soon as they notice an equipment, appliance, maintenance or housekeeping issue. Issues will be repaired or remedied as soon as possible. Circumstances outside of SkyRun Sarasotas control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. SkyRun Sarasota will not reimburse or refund any monies to the guest in the event of any of the above circumstances.

PEST CONTROL: Pest control services are performed regularly at each property. To keep the pest population under control, Guest agrees to allow pest control operators access to the property.

LOST & FOUND: It is the responsibility of the guest to ensure all personal items are gathered at departure time. Any item left behind in the property that a guest would like returned will be subject to a $35 handling fee plus packaging and shipping costs. We cannot guarantee an item left behind by a guest will be found.

PARKING: Parking may be limited at your specific property. SkyRun Sarasota will provide parking passes and/or parking guidelines including the maximum number of cars allowed. SkyRun Sarasota will NOT be held liable for ticketing and/or towing of guest vehicles. Guests exceeding the maximum number of cars will be asked to move additional cars or may be towed. No refunds or compensation will be paid to guests that ignore parking restrictions.

KEYS: All keys, keycards, remotes (if applicable) will be left in the unit on the kitchen counter prior to departure. Lost keys, keycards or remotes will incur a charge of $75 per item.

PETS: Pets are prohibited in the property at all times (including Emotional Support Pets), unless otherwise specified in the property listing and any associated pet fees have been paid. Any evidence of pets discovered in or around the home without permission will result in a $500 fine, plus charges for any damages sustained or extra cleaning required, at the sole discretion of SkyRun Sarasota.

SWIMMING POOLS & HOT TUBS: Guest use of any hot tub, spa or swimming pool assumes all risks and liability. Guests are advised that there are potential dangers to children who are not carefully supervised, as well as any person using hot tub or spa too long or if a person has health risks, is intoxicated, using any kind of drugs or medication, or is pregnant. Guests are advised that the chemicals used in the servicing and maintenance of the hot tub can lead to skin and eye irritations, rashes, and other reactions especially in children. Guest agrees to waive any claim whatsoever against SkyRun Sarasota, it's owners, contractors, employees, principals, agents, and associated property owners from any and all accidents, illness, or injury arising from use of any hot tub or spa. Guest agrees that he/she is responsible and liable for any damages that occur to the hot tub or spa through their or their guest's misuse or negligence. Should guest or guest's guests contaminate the water with any foreign substance by not abiding by the rules, guest agrees to an additional charge of $250 for hot tubs and $2,500 or more to cover the cost to drain, clean and refill the hot tub and/or swimming pool and to remediate the contamination to the filtering system. Each hot tub and pool are serviced prior to arrival and the chemical levels are checked and recorded.

UNFORESEEN ISSUES: Unforeseen and uncontrollable circumstances may occur during your stay including but not limited to, internet, TV, and utility outages, inclement weather, travel delays, limited availability of town services, the closing of common & home amenities (including hot tubs, pools, and fitness centers). Guests are not entitled to full or partial refunds for any unforeseen circumstances. SkyRun Sarasota, as an entity and the reservations associated with a home, are not part of or party to the sales contract for a home. In the event that a home is sold and future reservations are not accepted by the new homeowner, reservations are subject to cancellation or the reservation may be moved to another comparable SkyRun Sarasota property.

AGE & OCCUPANCY RESTRICTIONS: Guests must be at least 25 years old to rent a property from SkyRun Sarasota. At any time SkyRun Sarasota may request that the guest who reserved must provide a valid ID as proof of age. The person booking the property must be staying in the property for the entire duration of the guest stay. Maximum occupancy at any time is equal to the number of people the property sleeps, as listed per property. No people beyond that number are allowed at any time. Exceeding this occupancy is grounds for immediate removal from the property without refund. SkyRun Sarasota has the right to inspect the number of people in your property at any time.

PARTIES: No house parties, weddings, receptions or events are allowed at any SkyRun Sarasota property. If there is a party in the property (as further evidenced by a noise complaint, security report, or by excessive amounts of trash or destruction) the guest will be charged for a complete clean, replacement of damaged items and property, HOA fines, plus any additional charges necessary to return the home to its previous state. Such activities completely void the Damage Waiver.

TV: Most properties are equipped with standard cable service; this is a service paid by the homeowner and a benefit extended to the guest at no additional cost and provided by a local service provider. Guests are not entitled to, nor should they expect, access to Pay Per View, Netflix, HBO or any other premium channel. Guests may never call the 3rd party service to purchase or extend the provided service. Circumstances outside of SkyRun Sarasotas control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. SkyRun Sarasota will not reimburse or refund any monies to the guest in the event of any of the above circumstances.

INTERNET: Most properties are WiFi enabled; this is a service paid by the homeowner and a benefit extended to the guest at no additional cost and provided by a local service provider. SkyRun Sarasota cannot guarantee reliable or consistent internet service. Circumstances outside of SkyRun Sarasota control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. SkyRun Sarasota will not reimburse or refund any monies to the guest in the event of any of the above circumstances. If a guest wants to ensure optimized and reliable service, SkyRun Sarasota recommends guests travel with their own personal hotspot. The guest is accountable for any illegal activity that occurs on the network during their stay.

PHONE: Guests understand that phones (land line or VoIP) may not be present in a property and should not be expected. Guests are encouraged to have mobile phones charged for communication in an emergency. Some properties may have poor cellular coverage, which is beyond SkyRun Sarasotas control. Refunds and credits will not be provided to guests for slow or nonexistent service.

ELECTRICITY: SkyRun Sarasota cannot guarantee power, HVAC or electricity in the event of a power outage or interruption. SkyRun Sarasota will not reimburse or refund any monies to the guest in the event of any of the above circumstances.

WEATHER: Sarasota Island and the surrounding areas are subject to last minute, and sometimes severe, weather such as thunderstorms, icing, tornadoes and hurricanes. SkyRun Sarasota will not refund guests for any weather-related issues or inability to get to the property due to weather or flight delays/cancellations; or issues resulting in weather conditions such as power outages, etc.

LOCAL ORDINANCE: Guest agrees that they will not use, nor permit the use of the premises, for any unlawful or disorderly purposes, nor commit or permit a nuisance to be committed therein. Shooting of fireworks and carrying of firearms or excessive noise are prohibited.

COMMON-USE AREAS & HOAs: Condominiums, Villas, townhouses and many private homes are also managed by 3rd party Home Owners Associations (HOAs) regarding amenities. These HOAs manage and control shared amenities which include but are not limited to outdoor grills, hot tubs, pool, fitness areas, parking structures and areas, picnic areas and landscaping. Be aware that during non-peak times amenities may be unavailable due to circumstances out of SkyRun Sarasotas control such as building and amenity maintenance or closures. Also, even during peak times HOAs may need to make buildings and amenities unavailable for emergency maintenance and other reasons out of SkyRun Sarasotas control. For no reason will SkyRun Sarasota provide a refund if amenities are unavailable due to HOA closures or maintenance. SkyRun Sarasota offers vacation rentals 365 days a year and has no control over the availability of amenities controlled by HOAs or complexes; nor does SkyRun Sarasota have any obligation to disclose availability to guests. SkyRun Sarasota will not provide any refunds to guests for the unavailability of such services.

OWNERSHIP of PROPERTY: The guest acknowledges that they do not own nor have any rights to the property. The guest may never alter the appearance or function of any part or contents of the property at any time (this includes but is not limited to paint, window coverings, furniture, appliances, etc.). Additionally, the guest may never employ directly or on the behalf of SkyRun Sarasota or the homeowner a 3rd party contractor or vendor to perform any work or services within or to the property (this includes but is not limited to hiring housekeepers, handymen, contacting internet or TV providers directly). The guest may not move any furniture or electronics at any time.

Guest is NOT a tenant and has acquired no leasehold in the property. Guest is a licensee of the Owner. The term "rent" is used for convenience only.

FOR SALE: SkyRun Sarasota provides short-term rental services to properties that may be For Sale. If a property is For Sale, and a potential buyer would like to view or tour the property during a guest stay SkyRun Sarasota will notify the guest prior to the showing. If a property is sold, reservations may be cancelled and refunded, or the guest may be moved to another comparable SkyRun Sarasota property.

CAMERAS: For the protection of the home and Owner rights to continue to rent their home, be advised that some homes may have outdoor cameras in place to ensure compliance with local County, Town or HOA Short-Term Rental rules (parking compliance, noise violations, trash violations, etc.) and violations of terms and conditions will result in guest fines, ticketing or even eviction.

AUTHORIZATION FOR CHARGES: I hereby authorize SkyRun Sarasota to charge my credit card for any and all charges related to my rental that may include damage to the property, excessive cleaning or trash, unpaid fees and charges applicable to the rental. If I booked through a 3rd party, I agree that SkyRun Sarasota may pursue collections of monies due through the 3rd party and I agree that will comply with the policies and decisions of the 3rd party to award SkyRun Sarasota reimbursement of of any costs related to property damage, excessive cleaning or trash, unpaid fees and charges applicable to the rental. I further agree that I will not charge back said charges. I agree not to dispute charges made under this agreement.

WAIVER OF LIABILITY: By proceeding with this reservation and checking into the property, the reservation holder, representing members of his/her party and guests (hereinafter referred to individually and/or collectively as 'GUESTS') who desire to rent the referenced property (hereinafter referred to as 'PROPERTY' or 'the PROPERTY'), for short-term vacation purposes, hereby agrees to release and waive all liability in consideration for being permitted to enter PROPERTY. Each person who arrives on the PROPERTY does so at their own risk and accepts full liability and responsibility for that risk and whatever occurs to them while they are on or around the PROPERTY. GUESTS acknowledges and accepts these risks and RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT SUE SkyRun Vacation Rentals, SkyRun Sarasota or the OWNER of the PROPERTY, either personally and/or as a company or corporate representatives, including their members, managers, operators, officials, officers, directors, employees, owners and/or lessees of the PROPERTY, (herein referred to as 'RELEASEES').

In consideration for being permitted to enter the PROPERTY for vacation or any other legal purpose, GUEST agrees and represents that he/she will immediately upon entering, and continuously thereafter, thoroughly inspect the PROPERTY for any unsafe conditions, and if any part of PROPERTY is deemed to be unsafe at any time, GUESTS will immediately leave the area and advise the appropriate person(s).

WARNINGS: Use of decks, pools, hot tubs, bunk beds, fireplaces, and outdoor grills carry risks that may result in serious injury or death. Local terrain features on the PROPERTY including, but not limited to, hills, ledges, paths, and water access pose inherent risks to users. Swim at your own risk. No children under the age of 12 are permitted to use a hot tub at any time and must be accompanied and supervised by a parent or guardian at all times while in or near any swimming pool or other body of water. No children under the age of 12 are permitted on a deck without adult supervision. The American College of Obstetricians and Gynecologist (ACOG) states that becoming overheated in a hot tub is not recommended during pregnancy. Elderly persons and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar afflictions should not enter a hot tub without consulting their physician. Never use a spa while under the influence of drugs or alcohol or if you are taking medications of any kind, or being treated for any illness. A spa should be kept at a temperature less than 104 degrees for personal safety and all bathers must shower before and after use to decrease the possibility of skin problems. Do not sit or walk on a spa cover, or it will collapse. Supervise children at all times to decrease risk on injury, death or drowning.

GUEST hereby acknowledges that the PROPERTY OWNERs, SkyRun Sarasota and/or SkyRun Vacation Rentals cannot be held liable or responsible for harm to GUESTS from carelessness, the carelessness of the individual harmed, or the carelessness of others. The PROPERTY OWNER cannot be held liable or responsible for any harm or damage caused by acts of nature or God. Each person on the PROPERTY accepts full liability and responsibility for their own actions and their own possessions. By accepting this reservation, it is agreed that GUESTS are expressly assuming the risk and personal responsibility of any harm arising from their use of the PROPERTY.

GUEST also hereby certifies that they have adequate insurance to cover an injury or damage that may be caused or suffered while on the PROPERTY or in the area, or else agrees to bear the costs of such damage or injury. Each person who arrives on the property has read and understands the risks, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made. Guest agrees to hold harmless and indemnify SkyRun Sarasota, SkyRun Vacation Rentals, the OWNER and their agents from any loss or damage, including attorney's fees, incurred as a result of any and all claims, demands, causes of action, suits, judgments, fines or penalties arising out of Guest's use or occupancy of the property.

VIOLATIONS: Any violations of this rental contract and/or SkyRun Sarasota policies may result in immediate removal from the property.

ENFORCEMENT: Guest agrees to pay all court costs, and reasonable attorney fees incurred by SkyRun Vacation Rentals, SkyRun Sarasota or the OWNER in the enforcement of its rights under the Agreement.

GOVERNING LAW; SEVERABILITY: This Agreement shall be interpreted and enforced according to the laws of the State of Florida, the invalidity or unenforceability of any one or more provisions of this Agreement shall in no way effect any other provisions.

This rental agreement may be changed at any time and without notice.

ACKNOWLEDGEMENT: By accepting this reservation you acknowledge that you have read, and do hereby accept and will abide by, the terms & conditions contained herein.
